A ancoragem material das categorias jurídicas: Hans Kelsen à luz de Franz L. Neumann
Keywords:
Law, Science, University, Critique, DemocracyAbstract
We are living in an era of scientific denialism and attacks on universities, which prevents science from presenting itself as politically neutral. This context demands renewed reflection on the relationships among science, law, and democracy. To achieve this objective, this text revisits Franz L. Neumann's reading of Hans Kelsen, highlighting Neumann's objective of proposing a science of law that studies both facts and norms, and the limits of Kelsen's “value relativism” as the foundation of democracy, and the need to defend an engaged conception of science in general and the science of law in particular.
