This text proposes a reflection on the role of criminal judges in upholding the fundamental rights of individuals accused of committing crimes. To achieve this, it presents several criminological perspectives aimed at reducing the use of criminal law, such as non-contingent responses, adequacy/suitability, legislative representation of the prison population, respect for cultural autonomy, and culpability based on social vulnerability. Ultimately, the aim is to increase the complexity of the criminalization process, serving as a model for the Criminal Justice System.
